CPSM® Certification Pass Guarantee Terms.  This web site, and the materials offered, are provided by Jack Quinn Solutions, LLC (“JQS”).  Thank you for selecting the CPSM® Boot Camp Course to prepare for the CPSM® EXAM.  We realize that you could have chosen other avenues to study for the Exam.  We at JQS have worked very hard to prepare materials that are designed to help you pass the Exam as efficiently as possible, and we are deeply appreciative of your patronage.  We therefore are pleased to offer this Certification Pass Guarantee as an expression of our confidence in our course materials, and in you as the Exam taker.  This CPSM® Course Guarantee is a limited guarantee and applies only if you 1) take a CPSM® Exam within 30 days of completing CPSM® Boot Camp; 2) have fully paid JQS for the CPSM® Boot Camp Course; and 3) meet all the notification and diligence requirements below.  If, for any reason, your payment for CPSM Boot Camp is not completed in full this Guarantee will not apply.  If you meet these requirements and fail any of the CPSM Exams JQS will pay your costs to re-take the failed Exam, up to a total of two (2) Exam re-takes.  In no event shall JQS pay for more than two (2) Exam retakes total.  For example, if you meet the above requirements and fail Exam 1, JQS will pay your costs to take Exam 1 again.  If you fail Exam 1 for a second time, JQS will pay your costs to take Exam 1 a third time with no further obligations by JQS under this Guarantee.  If you pass Exam 1 on the second attempt and fail Exam 2 on the first attempt, JQS will pay your costs to re-take Exam 2 with no further obligation by JQS under this Guarantee.  If you pass Exam 1 the second attempt, pass Exam 2 on the first attempt, and fail Exam 3 on the first attempt, JQS will pay your costs to re-take Exam 3 with no further obligations on JQS’s part under this Guarantee.  And so on.  In no event shall JQS make payment under the terms of this Guarantee directly to you; rather, JQS will fulfill its obligations under this Guarantee by making payment directly to, and only to, the CPSM® Exam provider.  In order for this Guarantee to be valid, you must not have taken any steps yourself which contributed to your Exam failure.  Such steps as failing to study, failure to fully take the exam or to fully utilize the time allotted for taking the Exam, and drug or alcohol abuse are examples.

*** This Guarantee will be valid if and only if you notify JQS in writing by email to:   CPSMguarantee@cpsmtraining.com that you intend to proceed under a re-take of the failed Exam within thirty (30) days of notice of your failure being made available to you.   YOU MUST PROVIDE PROOF OF THE DATE THE EXAM PROVIDER MADE NOTICE OF YOUR FAILURE AVAILABLE TO YOU WHEN YOU SEND YOUR WRITTEN NOTICE.  If you do not notify JQS by email to this address of your intention to re-take the failed Exam within the time prescribed above, or if you fail to provide the above proof in that time, you will have permanently waived any rights you have under this Guarantee.    ***

NO OTHER WARRANTY.  THERE ARE NO OTHER WARRANTIES OR GUARANTEES, EITHER EXPRESS OR IMPLIED, MADE BY JQS FOR THE MATERIALS, GOODS AND/OR SERVICES PROVIDED.  JQS EXPRESSLY DISCLAIMS ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE AND ANY WARRANTY OF MERCHANTABILITY.  JQS SHALL NOT BE HELD LIABLE FOR ANY DAMAGES OF ANY TYPE OR NATURE, EITHER DIRECT, SPECIAL, CONSEQUENTIAL, THIRD PARTY OR OTHERWISE, ARISING FROM ANY USER’S UTILIZATION OF THE PROVIDED MATERIALS, GOODS AND/OR SERVICES.  THE COURSE MATERIAL, WHILE BEING DEVELOPED BY PROFESSIONAL TRAINERS WITH THE FULL INTENT OF PROVIDING PROFESSIONAL AND EFFECTIVE TRAINING FOR THE PURPOSE OF PASSING THE CPSM® EXAM, ARE PROVIDED “AS-IS”. ALL USE OF THIS WEB SITE, ANY WEB SITE PROVIDED BY JQS, AND/OR THE MATERIALS, GOODS OR SERVICES PROVIDED ON THIS OR ANY JQS WEB SITE IS EXPRESSLY CONDITIONAL ON THE USER’S ACCEPTANCE OF THESE TERMS.  YOUR STATE MAY GRANT YOU SPECIFIC RIGHTS UNDER STATUTE OTHER THAN THOSE ENUMERATED HEREIN.
